COLLECTION OF INFORMATION


Information That You Provide to Us
PGA TOUR Superstore may collect information that you provide directly to PGA TOUR Superstore through the Sites. For example, we collect information when you set up an account, submit an order, participate in promotional activities, or communicate with PGA TOUR Superstore through the Sites. This information may include: (1) personally-identifiable information, which is information that identifies you personally, such as your first and last name, email address, phone number, mailing address, payment card information, social media account handles, and/or professional information (“Personal Information”); and (2) demographic information, such as age, gender, zip code, interests, and recent and upcoming purchases (“Demographic Information”). Also, in certain instances, PGA TOUR Superstore may modify or extract personally identifiable elements from Personal Information through anonymization, pseudonymization, or hashing. Such information is considered to be non-Personal Information and may be shared without obligation to you, except as prohibited by applicable law. However, to the extent that any non-Personal Information is combined by or on behalf of PGA TOUR Superstore with Personal Information, we will treat the resulting data as Personal Information under this Policy.

Information Collected Automatically
PGA TOUR Superstore may also automatically collect and log certain information about you when you access or use the Sites (“Usage Information”). Usage Information may include IP address, device identifier, browser type, operating system, approximate geographic area or location positioning information, information about your use of the Sites, and data regarding network connected hardware (e.g., computer or mobile device). Usage Information may also include your mobile device such as the type and model, operating system (e.g. iOS or Android), carrier name, mobile browser (e.g. Chrome, Safari), applications using our Website, and identifiers assigned to your device, such as its iOS Identifier for Advertising (IDFA), Android Advertising ID (AAID), or unique device identifier. PGA TOUR Superstore may obtain information about you from other sources, including its affiliates, vendors, or third-party service providers, and combine it with your Personal Information. Log Information

PGA TOUR Superstore may use information about you for any purpose that is not inconsistent with this Policy or a statement made by PGA TOUR Superstore at the point of collection, including, without limitation, the following:

    Service Providers: PGA TOUR Superstore agents, vendors, consultants, and other service providers (collectively "Service Providers") may receive, or be given access to, your Personal Information in connection with their work on our behalf, provided that PGA TOUR Superstore does not authorize such Service Providers to use the Personal Information to send you direct marketing messages absent your consent (which may be by opt-in or opt-out), with the exception of messages related to PGA TOUR Superstore and our Affiliates.
  • Affiliates: PGA TOUR Superstore may share your Personal Information with the affiliates of PGA TOUR Superstore.

When ordering products or interacting with certain services offered on the Sites, you may be presented with an option to have PGA TOUR Superstore send certain pieces of information to third parties.   • Co-Branded Areas. Certain areas of the Sites may be provided to you in association with third parties (“Co-Branded Areas”), such as sponsors or charities, and may request or require you to disclose Personal Information to them. If you elect to register for products and/or services, communicate with such third parties, or download their content or applications, you may be providing your information to both PGA TOUR Superstore and the third party.   • Sweepstakes, Contests and Promotions. PGA TOUR Superstore may offer sweepstakes, contests, and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your information, including Personal Information, may be disclosed to PGA TOUR Superstore, co-sponsors, and other third parties.   • EEOC/Affirmative Action Reporting. To the extent that you apply for or are otherwise considered as a candidate for employment with PGA TOUR Superstore, in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission (“EEOC”), the Office of Federal Contract Compliance Programs (“OFCCP”) and similar state and local regulatory agencies, we may ask you to provide us with self-identifying information (such as veteran status, gender and ethnicity). Providing such self-identifying information is voluntary, but if you do provide us with information, we may submit that information, to the EEOC, the OFCCP and/or similar state and local regulatory agencies or otherwise use or disclose it for business-related purposes, including, without limitation, responding to information requests, fulfilling regulatory reporting requirements and defending against employment related complaints.
Under certain circumstances, PGA TOUR Superstore reserves the right to disclose your Personal Information to a third party if it is necessary to:

The Sites include functionality that allows certain kinds of interactions with a website, platform, tool, application, or other service that is not owned or operated by PGA TOUR Superstore (“Third-Party Services”). For example, we provide interfaces or links on the Sites to facilitate your sending a communication from the Sites (e.g., tweets, “likes”, content submissions, or other postings on social media platforms). Unless otherwise indicated, this Privacy Policy does not apply to Third-Party Services. To the extent that we combine such third-party sourced information, we will treat that as Personal Information under the Policy. TRACKING AND COMMUNICATIONS OPTIONS


Accessing and Changing Information
The Sites may allow you to delete, correct, or update some of the Personal Information you provided to PGA TOUR Superstore. We will make good faith efforts to make requested changes in our then-active databases as soon as practicable, but it is not always possible to completely change, remove or delete all of your information as residual and/or cached data may remain archived thereafter. Further, we reserve the right to retain data (i) as required by applicable law; and (ii) for so long as reasonably necessary to fulfill the purposes for which the data is collected (e.g., business records).

Tracking Technologies Generally
Cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Please note that if you elect to opt-out of PGA TOUR Superstore communications, you may also be opting-out of receiving promotional communications from our affiliates. However, even if you opt-out of receiving promotional communications, PGA TOUR Superstore may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or PGA TOUR Superstore’s ongoing business relations. CHILDREN’S ONLINE PRIVACY PROTECTION


The Sites are not directed to children, and PGA TOUR Superstore does not knowingly collect personal information from children under the age of 13 through the Sites. If we learn that we have received personal information from a child under the age of 13 through our Sites, we will delete the information in accordance with applicable law.

PGA TOUR Superstore is the controller of your Personal Data as described in this Privacy Policy, unless specified otherwise. This Policy does not apply to the extent the we process Personal Data in the role of a processor or service provider on behalf of our customers.

  • Identifying Customer Opportunities: We process your Personal Data to assess new potential customer opportunities to the extent that it is in our legitimate interest to ensure that we are meeting the demands of our customers;
  • Displaying Personalized Advertisements and Content: We process your Personal Data in order to conduct marketing research, advertise to you, provide you with personalized information about us, and to provide other personalized content based upon your activities and interests to the extent it is necessary for our legitimate interest in advertising our Sites or, where necessary, to the extent you have provided your prior consent;

We will store your Personal Data for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the information was collected, or as may be permitted under applicable law.   • Restrict our processing of your Personal Data;
  • Transfer your Personal Data to another controller, to the extent possible;

This California Privacy Notice is effective as of January 1, 2020.

This notice reflects our good faith understanding of the law and our data practices as of the date posted above, but the CCPA’s implementing regulations are not yet final and there remain differing interpretations of the law.     EXERCISING YOUR CALIFORNIA ACCESS, DELETION AND DO NOT SELL RIGHTS


    California residents have the right to request that we disclose to you what Personal Information we collect, use, disclose, and sell, including the right to request that we provide to you the specific pieces of Personal Information we have collected about you in the prior 12 months ("Right to Know") and you have the right to ask us to delete the Personal Information we collect about you ("Right to Delete"), subject to exceptions set forth in the CCPA. Please note that you may delete certain Personal Information you have provided to us through your online account.

    California residents also have the right to opt-out from the sale of their Personal Information. These rights are subject to some limitations, such as when we are retaining data to comply with our own legal obligations. You will not be required to create an account with us in order to submit a request.

    Making A Request
    To request the specific pieces of Personal Information we have collected about you in the prior 12 months, please call 1-888-200-7428 or fill out our webform here. We will provide the requested information free of charge up to two (2) times in a 12-month period, but please note that where we receive unfounded, excessive, or repetitive requests, we may elect to decline the request. We will not retain information we do not ordinarily retain in the course of our regular business practices.

    In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. We will require verification that you provided the authorized agent permission to make a request on your behalf. You must provide us with a copy of the signed permission you have given to the authorized agent to submit the request on your behalf and verify your own identity directly with us.

    If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of the following information to the request:
    1. A completed authorized agent designation form or power of attorney indicating that you have authorization to act on the consumer’s behalf.
    2. If you are a business, proof that you are registered with the Secretary of State to conduct business in California.
    If we do not receive both pieces of information, the request will be denied.

    Verifying Requests
    Please note that we will take steps to verify your identity in order to fulfill your request. We will first verify your email address is active and we will take steps to verify the information you provide to us. If you have an account with us, please have your account information available when you call or email the address above to facilitate verification.

    If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf) we will not process the request.

    Response Timing
    When you request access to the Personal Information we have collected or deletion of your Personal Information, we will typically provide the requested information within 45 days, and we will notify you within that time period if we need additional time to process your request. When you opt-out from the sale of your Personal Information, we will honor your request as soon as feasibly possible, but no later than 30 days from the date we receive your request.

    RIGHT TO OPT-OUT OF THE SALE OF PERSONAL INFORMATION


    The CCPA requires businesses to disclose whether they sell Personal Information. As a business covered by the CCPA, we may sell Personal Information to third parties or allow them to collect Personal Information from our Sites if those third parties are authorized Service Providers or business partners with whom we have a contractual arrangement that addresses any sales of Personal Information.     There may be cookies and other tracking technologies associated with our online services that may provide data, which may be treated as Personal Information under the CCPA, to other parties that may use it for their own purposes, which in turn may provide that data to other parties for their own purposes. While there is not yet a consensus, we do not believe that data practices of third-party cookies and tracking devices associated with our online services constitute a sale of Personal Information by us and therefore we do not currently treat these activities as a “sale.”

    NON-DISCRIMINATION AND FINANCIAL INCENTIVE PROGRAMS


    California consumers have the right to not receive discriminatory treatment for exercising CCPA rights. We will not discriminate against you for exercising your CCPA rights.

    However, we may charge a different price or rate, or offer a different level or quality of good or service, to the extent that doing so is reasonably related to the value of the applicable data. In addition, we may offer you financial incentives for the collection, sale, retention and use of your PI as permitted by the CCPA that can, without limitation, result in reasonably different prices, rates, or quality levels. The material aspects of any financial incentive will be explained and described in its program terms. Please note that participating in incentive programs is entirely optional and you can opt-out of each program (i.e., terminate participation and forgo the ongoing incentives) prospectively by following the instructions in the applicable program description and terms.

    CALIFORNIA SHINE THE LIGHT LAW


    If you are a California resident, in addition to the rights set forth above, you have the right to request information from us regarding the manner in which we share certain categories of your personal information with third parties for the third parties' direct marketing purposes. California law provides that you have the right to submit a request to us on the designated webform and receive the following information:
    • The categories of information we disclosed to third parties for the third parties' direct marketing purposes during the preceding calendar year;
    • The names and addresses of third parties that received such information, and
    • If the nature of a third party's business cannot be reasonably determined from the third party's name, examples of the products or services marketed.

    NOTICE TO NEVADA RESIDENTS


    If you are a Nevada resident, in addition to the rights set forth above, you have the right to request that we do not make any sale (as such term is defined in N.R.S. 603A) of your covered information (as such term is defined in N.R.S. 603A.320) that we may have collected from you (or may collect from you in the future). PGA TOUR Superstore may sell Personal Information to third parties if those third parties are authorized business partners with whom we have a contractual arrangement that addresses any sales of Personal Information.     PLAYER'S CLUB FINANCIAL INCENTIVE NOTICE


    This Financial Incentive Notice applies to the Players’ Club. We may add or change the benefits of the Players’ Club, which are described in the Players’ Club Terms, from time to time, so check them regularly. In summary, the Players’ Club allows members to accumulate points per purchase and get reward cards based on the amount of points.

    Participating in the Players’ Club is entirely optional and is subject to the Players’ Club Terms. If you opt-in online, you must opt-in by signing up for a Players’ Club Account here. If you opt-in in store, you must opt-in by following the process as instructed by our in-store sales associates or as indicated by our registers’ screens.

    The Players’ Club collects Personal Information to facilitate its operations and provide you with Players’ Club benefits, including sending you Players’ Club specific promotions. Personal Information collected includes Identifiers, Personal Records, Personal Characteristics, Commercial Information, Internet or Other Electronic Network Activity Information, Geolocation Data, and Professional or Employment information. We also generate Inferences from Program Data.

    We value Personal Information collected as part of the Players’ Club by considering several factors, including the additional revenue generated through the relationship we have with Players’ Club members offset by our expenses related to the collection or retention of Personal Information, and the expenses related to the offer, provision, or imposition of the Players’ Club. We consider the benefits of the Players’ Club, which are described in the Players’ Club Terms, as reasonably related to the value of the Personal Information processed for the Players’ Club. For the sake of clarity, we may offer bundle memberships where you may purchase additional benefits under a different membership along with a membership to the Program. The purchase of and the additional benefits of bundle memberships are not governed by these Terms; such additional benefits of bundle memberships are described separately.

    California Consumers may withdraw from the Players’ Club at any time by calling us at 1-888-200-7428 or emailing us at customerservice@pgatss.com. We may request confirmation, such as through email, for the withdrawal from the Players’ Club. If a California Consumer withdraws from the Players’ Club, we will delete associated Personal Information to the degree the Personal Information is solely associated with the Players’ Club (e.g., we may not delete your email address if you’ve signed up for marketing newsletters separate from the Players’ Club). Additionally, some associated Personal Information may be retained for record keeping, tax reporting, and other legally permissible purposes.

    California Consumers will continue to be able to exercise CCPA privacy rights. If exercising your CCPA privacy rights will affect your Players’ Club membership (such as by causing termination of your Players’ Club membership), we will (1) honor your request for Personal Information not associated with your Players’ Club account and (2) provide you information on how your request may affect your Players’ Club membership and ask you to confirm your request with regard to Personal Information associated with the Players’ Club.
